Warranteed: Terms of Use & Service Agreement

1. The Service: The Warranteed Standard
Warranteed provides a digital registry and advocacy platform (the "Vault") designed to facilitate product registration and warranty claim management. By scanning a Warranteed QR code or manually entering a Product Trio (Serial Number, UPC, and Product Code), you are initiating a Shadow Account or an Active Account to secure your post-sale recourse.
2. Electronic Signatures & Acceptance
By clicking "Accept," "Verify," or by continuing to use the Vault, you agree to be bound by these terms. Pursuant to the U.S. E-SIGN Act, you acknowledge that your electronic acceptance has the same legal force and effect as a physical signature.
3. Account Types: Shadow vs. Active
Shadow Accounts: Created upon the initial scan and submission of an email address. These accounts are "Unverified" and hold the product data in trust until a claim is filed.
Active Accounts: Created when a user verifies their identity via Auth Token (Magic Link) or Biometric Authentication (FaceID/TouchID) and provides necessary fulfillment data (Address/Phone).
User Responsibility: You agree that the email provided is yours. Warranteed is not responsible for registrations linked to incorrect or unauthorized email addresses.
4. The "Trio" Validation & Data Integrity
Warranteed acts as the Registry of Record. We verify the authenticity of a product based on the "Trio" data provided by the Manufacturer or Vendor.
- Warranteed does not guarantee the physical condition of the product at the time of unboxing.
- Warranteed reserves the right to void any registration if the Serial Number is found to be fraudulent, duplicated, or tampered with.
5. Role of the Manufacturer & Vendor
Warranteed is an advocate, not a warrantor.
- Manufacturer Responsibility: The manufacturer remains solely responsible for the fulfillment of warranty claims, repairs, and replacements.
- Vendor Responsibility: The vendor is responsible for the accuracy of the sales data provided to the Warranteed Archive.
- The Portal: Decisions regarding the approval or denial of a claim are made strictly by the Manufacturer within their specific Manufacturer Portal.
6. Passwordless Authentication & Security
- Auth Tokens: Users agree that access to their registered email address constitutes authorization to access the Vault.
- Biometrics: On supported mobile devices, FaceID/TouchID data stays on the local device's Secure Enclave; Warranteed only receives a success/fail token.
- Software "As-Is": The service is provided on an "as-is" and "as-available" basis. Warranteed is not liable for temporary service interruptions or data sync latencies.
7. Privacy & Data Usage (The "No-Island" Policy)
We stand with the customer. Your data is used to facilitate your recourse:
- Sharing: By registering a product, you authorize Warranteed to share your contact info and the Product Trio with the specific Manufacturer of that item to facilitate support and safety recalls.
- No Third-Party Sales: Warranteed will not sell your personal "Vault" data to outside marketing firms. We are a utility, not a data broker.
8. Limitation of Liability & Arbitration
Warranteed is a platform to assist in communication. We are not liable for product defects, personal injury, or a manufacturerβs failure to respond.
- Dispute Resolution: You agree that any dispute arising from this agreement shall be resolved through binding arbitration rather than in court, though the proceedings shall be governed by the laws of the State of Illinois.
9. Governing Law
This agreement is governed by the laws of the State of Illinois. For any matters not subject to arbitration, jurisdiction shall lie in the courts of Cook County (Northbrook/Chicago).
